You offer wireless Internet in your hotel, your guest downloads a film illegally - who is liable?

This matter, among others, is regulated by EU Directive 2006/24/EG concerning data retention, which has to be transposed into national law by all EU countries. In Austria, for example, it will be put into practice on  January 1st, 2009.

Corporate and Guest networks: Safety first!

In Austria, companies already have to separate their "public network" or guest network from their corporate network.

For the hotel sector, this is especially important  when deciding whether or not to offer guests Internet access. In this case, it is irrelevant in which way Internet access is offered to guests (wirelessly, via cable, or via an Internet terminal, ...).

  

The "provider" (in this case, the hotelier) is obliged to clearly separate the guest network from the corporate network (e.g. direction, administration, reception). Only in this way the liability for "illegal activities" (illegal downloading of films, music, child pornography etc.) over the internet connection is clear.

Apart from being conform to the law, this solution also has the advantage that guests cannot unintentionally (or even intentionally) access internal data of your hotel's administration.

Access logging

Besides the separation of the two networks, it is necessary to be able to prove on request, that it was one of your guests, customers or visitors and not the hotelier or a member of the staff who was surfing over your internet connection. This problem is best solved with individual accounts: Each of your guests gets their own and unique account (voucher). On-line activities can therefore be tracked down to one particular guest. These accounts are individually limited in time.

Identification of a guest

The accounts are assigned to the customers when the vouchers are given to them. If you wish so, we can save the protocols ("logfiles") that are created by the Hospot system for you. By saving data such as date, time, MAC adress, IP adress, login data and contents that were accessed, you can easily allocate which guest did what on the Internet.


Solution

Funknetz.at offers you the required equipment as well as the technical know-how to adapt your hotel's network to the EU Directive. There is no extra effort required from you or your guests, and your wireless network service remains comfortable and easy to use - but it will be safe.

If you are already offering your guests wireless Internet, your existing devices can be adapted by Funknetz.at to meet the modern requirements. However, our packages already comprise these functions.
Example: You can print out vouchers with access data by simply pressing a button and give them to your guests. A copy of the voucher is assigned to the guest and remains with you for your records. For large hotels, there is the possibility to link our software to your accounting system software (e.g. GMS or Micros Fidelio).
